Your account
You need an account to use TrademarkPing. You're responsible for keeping your login credentials secure and for anything that happens under your account. You must be able to enter into a binding contract to sign up — generally, 18 or older.
What the service does
TrademarkPing watches new trademark applications filed with the USPTO (and, in the future, other registries) and alerts you when one is confusingly similar to a trademark you're watching, using text, phonetic, semantic, and optional visual/logo similarity matching. We only read publicly available filing data — we never access, file, or modify any legal registration on your behalf.
Not legal advice
TrademarkPing is a monitoring tool, not a law firm, and does not provide legal advice. A similarity match is a signal worth your attention, not a legal determination of infringement, and TrademarkPing does not guarantee comprehensive clearance of any mark or jurisdiction. Decisions about opposing a filing, enforcing a mark, or any other legal action are yours to make, ideally with a qualified trademark attorney.
Watching trademarks you don't own
You may watch any trademark, including one you haven't registered yet or one owned by someone else (for competitive awareness). Don't use TrademarkPing to harass, impersonate, or interfere with another party's legitimate trademark activity.
Subscriptions
Plans are limited by the number of trademarks you can actively watch at once. Subscriptions are billed through LemonSqueezy or Freemius and renew automatically until cancelled. You can change or cancel your plan at any time from Billing; downgrades take effect at the end of the current cycle so you keep what you already paid for.
Accuracy of matching
Matching relies on third-party data sources (trademark registry filings, AI similarity models) and factors outside our control. We can't guarantee zero false positives, zero false negatives, or that every relevant filing is caught or caught immediately — coverage is currently limited to USPTO filings. TrademarkPing is a monitoring aid, not a substitute for a comprehensive trademark search or legal clearance opinion.
Notification delivery
When you connect Telegram, you're granting TrademarkPing permission to send messages to the bot/chat you configure until you disconnect it. You can revoke access at any time from Notification settings.
Service availability
We aim to keep TrademarkPing running reliably, but we don't guarantee uninterrupted access — third-party services we depend on (trademark registries, AI providers, Telegram) can occasionally have outages outside our control.
Cancellation
You can cancel your subscription at any time; access continues until the end of the billing period you've already paid for. Removing a trademark stops active watching on it — historical billing records are retained as described in our Privacy Policy.
Limitation of liability
TrademarkPing is provided "as is." To the extent permitted by law, we're not liable for indirect damages, lost profits, or damage arising from a filing we failed to detect or notify you about in time, or from any decision made based on our matching results — our aggregate liability is limited to the amount you paid us in the 12 months before a claim.
Changes to these terms
If we make a material change, we'll post an update here and, where appropriate, notify you directly. Continued use after a change means you accept the updated terms.
